This Distance Sales Contract (the “Contract”) is made between the SELLER named below and the BUYER when the BUYER confirms the order electronically. It is governed by Law No. 6502 on Consumer Protection and the Distance Contracts Regulation. The details specific to the order (items, quantities, prices, total, delivery and invoice details) are shown on the checkout page before the order is confirmed and form an integral part of this Contract.

1.2. BUYER
The BUYER is the consumer, a natural person acting for purposes outside trade or profession, who gives their name, contact, delivery and invoice details when ordering. The BUYER declares they are over 18. The BUYER’s details appear, for each order, on the order screen and in the confirmation email.
Article 2. Subject of the Contract
2.1. The subject of this Contract is the sale and delivery of the piercing jewelry and accessories the BUYER orders on https://piercingland.com.tr, and the parties’ rights and obligations in respect of that sale.
2.2. The name, quantity, material, size, colour and other basic characteristics of the item, and its price, are shown on the product page and in the order summary. Unless a product page says so expressly, piercing services, needles, piercing equipment and aftercare or cleaning products are not covered by this Contract.
2.3. Items are sold new and unused. Items are not sterilised before sale and, unless the product page says otherwise, are not sent in sealed or sterile packaging; this is also stated on the product pages and in the preliminary information form.
2.4. This Contract concerns consumer transactions. A company invoice can be issued for purchases made for trade or professional purposes, but such purchases may not fall under consumer-law protection.
Article 3. Making of the Contract
3.1. Before confirming the order the BUYER reviews, and separately confirms having read and accepted, the item’s basic characteristics, the total price including taxes, any shipping fee, the payment and delivery information, the explanations of the right of withdrawal and the Preliminary Information Form.
3.2. Pressing the order button creates an obligation to pay, and the button says so plainly. The Contract is made when the BUYER confirms the order in this way. The date and time, the version of the texts confirmed, the IP address and the browser details are recorded.
3.3. The “order received” email does not mean the item has been shipped. “Order received”, “payment confirmed” and “shipped” are separate stages, each notified at its own stage.
3.4. A copy of the Contract and the Preliminary Information Form filled in with the order’s details is given to the BUYER, attached to the order confirmation email and downloadable from the order page.
Article 4. Item Characteristics and Descriptions
4.1. The item’s name, pictures, material, size, colour, the placements it suits, its use and care information and its price appear on the product page.
4.2. Slight colour differences caused by screen and lighting do not affect the item’s conformity with its description.
4.3. The SELLER gives only verifiable information about items. Terms such as “hypoallergenic”, “causes no allergy”, “implant grade” or “medical grade” are used only where documents supporting them exist for that item, and only on that item’s page.
4.4. A BUYER with a known sensitivity to a material is advised to read the material information on the product page before ordering and, where needed, to consult a health professional.
Article 5. Price and Taxes
5.1. Prices are shown in Turkish lira, VAT included. The total shown on the checkout page includes the item price, discounts and any shipping fee.
5.2. Any shipping fee is shown inside the total before the order is confirmed. No extra payment that was not announced beforehand is requested without the BUYER’s express consent.
5.3. Price changes announced after an order is confirmed do not affect an order already placed.
Article 6. Payment
6.1. Payment is made by the methods active on the site: bank or credit card (with 3D Secure) on the PayTR secure payment page, and bank transfer (havale/EFT). The methods and instalment options on offer are shown at the payment step.
6.2. Card details are entered on PayTR’s secure page; the SELLER does not see or store the card number or security code.
6.3. For a transfer, the account details and a reference made of the order number are shown when the order is completed and sent by email. The payment is matched to the order by the order number in the reference. The order is not prepared until payment is received.
6.4. When a card payment is not completed or fails, the stock is released for sale again. A BUYER whose card was charged but who received no order confirmation can contact the SELLER with the order number and transaction details; an order is not cancelled until the charge has been checked.
Article 7. Preparation and Delivery
7.1. The item is handed to the carrier within 1–3 business days after payment is confirmed and in every case delivered to the BUYER within 30 days of the order date at the latest. The 1–3 business days is the preparation time needed to ship; it is not the carrier’s delivery time.
7.2. Delivery is by Yurtiçi Kargo to the address in Türkiye that the BUYER gave in the order. We ship within Türkiye only. When the item is handed to the carrier the tracking details are emailed to the BUYER.
7.3. Handing the item to the carrier is not delivery to the BUYER. The risk of loss and damage stays with the SELLER until the item is actually delivered to the BUYER or to a third party the BUYER names.
7.4. If the parcel is visibly damaged on delivery, a report drawn up with the courier is recommended. The absence of a report does not remove the BUYER’s statutory rights.
7.5. The BUYER must give the delivery address and contact details correctly and completely. For delays caused by wrong or incomplete details, responsibility is assessed according to the circumstances.
7.6. If the SELLER learns it cannot fulfil the order within the 30-day period, it tells the BUYER without delay and in any case before the period ends; the BUYER may terminate the Contract and the SELLER refunds what it collected within 14 days. An item that is out of stock is not shown as available; even so, if an item cannot be supplied the BUYER is informed in the same way and the price is refunded.
Article 8. Collection from the Shop
8.1. If the BUYER chooses to collect the order from the shop, they are told by email when it is ready. The item is kept for 3 days from that notice; if it is not collected in that time the SELLER contacts the BUYER, and not collecting does not by itself remove the BUYER’s right of withdrawal or other statutory rights. No shipping is charged for collection. The collection point is the shop at the SELLER’s address given above; showing the order number is enough when collecting.
Article 9. Invoice
9.1. The SELLER issues an invoice that complies with tax law for the sale. Invoices are issued electronically (an e-Arşiv invoice; an e-Fatura if the BUYER is an e-Fatura user), sent as a PDF to the invoice email address the BUYER gave when ordering or, if none, to the order email address, and issued within seven days of delivery of the goods at the latest, as the Tax Procedure Law provides. For collection from the shop, the invoice is issued at handover. A BUYER who wants a paper copy can ask by email. A personal invoice does not require a national ID number; a company invoice requires the company name, tax office and tax number.
9.2. The BUYER must give invoice details correctly and completely. Mistakes noticed before the invoice is issued are corrected when reported to the SELLER; changes to an issued invoice are made by the method tax law allows.
Article 10. Cancelling an Order
10.1. Before the item is shipped, the BUYER can ask to cancel the order by writing to info@piercingland.com.tr or by phone/WhatsApp. The request is handled according to the order’s preparation and shipping status; a shipping label having been created does not mean the item has been handed to the carrier.
10.2. Once the item has been shipped, the matter is handled under the rules on withdrawal and returns. Shipping does not remove the BUYER’s statutory right of withdrawal.
10.3. When a cancellation is final, the payment is refunded by the method in article 11.6 and the stock record is updated.
- Article 11. Right of Withdrawal
- 11.1. The BUYER has the right to withdraw from the Contract within 14 days of receiving the item, without giving any reason and without paying any penalty. Notice of withdrawal can also be given before the item is delivered. If several items in one order are delivered separately, the period runs from the day the last one is received.
11.2. Notice of withdrawal is given to the SELLER in writing or on a durable medium before the 14 days end (email: info@piercingland.com.tr; KEP: huseyin.olmez.5@hs01.kep.tr; post: Yukarı Bahçelievler Mah. Aşkabat Cad. No: 47, İç Kapı No: 2, Çankaya / Ankara). The BUYER may use the withdrawal form attached to this text; using it is not required. Keeping a record that shows the notice was sent in time (the email, the KEP message or the postal receipt) is recommended.
11.3. The BUYER sends the item back to the SELLER within 14 days of giving notice of withdrawal. The SELLER has not named a return carrier in this Contract or the pre-contract information; the BUYER can therefore send the item with any carrier and the return shipping cost is paid by the SELLER. The BUYER is not charged for return shipping. The return goes to the SELLER’s address, Yukarı Bahçelievler Mah. Aşkabat Cad. No: 47, İç Kapı No: 2, Çankaya / Ankara. It helps if the BUYER emails the order number to info@piercingland.com.tr before sending; this is not a permission or approval needed to exercise the right of withdrawal.
11.4. If the BUYER has used the item beyond what is needed to inspect it, the BUYER is liable for the resulting loss of value only to the extent the law provides. This clause gives no right to deduct or refuse that the law does not give.
11.5. Cases where the right of withdrawal cannot be used:
In addition, the SELLER gives a 6-month shop warranty on steel and titanium pieces: the piece does not tarnish or change colour, and the metal is the steel or titanium stated on the product page. On pieces with stones the stones are zircon; on opal models the quality of the stone is also covered. A stone coming loose is not covered. Pieces made of steel and titanium together do not carry this extra warranty. The warranty does not limit the BUYER’s statutory rights.
Items made to the BUYER’s wishes or personal needs, that is, made for the BUYER to a size, letter, name or design the BUYER chose, cannot be withdrawn from (Distance Contracts Regulation Art. 15/1-b). Standard items sent from stock are not covered.
Goods whose return is unsuitable on health and hygiene grounds, if their protective elements such as packaging, tape, seal or pouch have been opened after delivery, cannot be withdrawn from (Distance Contracts Regulation Art. 15/1-ç). The SELLER relies on this exception only for items whose product page states they are sent in sealed or sterile packaging and whose protective packaging was opened after delivery. For items not sent in protective packaging the exception is not relied on.
11.6. After receiving the notice of withdrawal and the item back, the SELLER refunds everything it collected from the BUYER and any initial delivery costs within 14 days. The start of that period is set by the refund rules of the Distance Contracts Regulation: it runs from the BUYER handing the item to the carrier the SELLER named, or, if another carrier was used, from the item reaching the SELLER. The refund is made by the means of payment the BUYER used: to the same card for card payments, and for transfers to an account in the payer’s own name. The BUYER is not charged anything further. How long the refund takes to show depends on the bank and the payment institution.
11.7. These provisions on cases where withdrawal is not possible do not remove the BUYER’s rights for faulty, damaged, incomplete or wrong items (article 12).
Article 12. Faulty, Damaged, Incomplete or Wrong Items
12.1. If an item is faulty, damaged, incomplete or different from what was ordered, the BUYER may choose one of the remedies listed in Article 11 of Law No. 6502: withdrawing from the contract, a price reduction, free repair, or replacement with a sound item. These rights apply even if the item’s protective packaging has been opened and can be used for two years from delivery. In that case all costs are the SELLER’s. Sending photos, a report or using a particular channel is not a precondition for these rights, though photos speed up the inspection.
Article 13. Use of the Item and Safety
13.1. The BUYER should read the material, size, fit and care information on the product page. For an item going into a new piercing, having it fitted by a piercing professional is recommended.
13.2. Items are not presented as medical devices; the care and health information on the site is general information and not medical advice. In case of signs of infection or an allergic reaction, see a doctor.
13.3. This article does not remove the SELLER’s statutory obligations on the item’s conformity with its description and on product safety.
Article 14. Personal Data and Commercial Electronic Messages
14.1. The personal data needed for the order, payment, delivery, invoicing and customer support is processed. Details are in the Privacy Notice on the site; no explicit consent is asked of the BUYER for that notice.
14.2. Permission for marketing commercial electronic messages is asked for separately from acceptance of this Contract, is optional and is never pre-ticked; not giving it does not prevent ordering.
14.3. Information and choices on cookies are given through the Cookie Policy and the cookie preferences tool.
Article 15. Force Majeure
15.1. Events outside the parties’ reasonable control, such as natural disaster, fire, epidemic, war, public authority decisions or a general breakdown of transport networks, may affect delivery. The BUYER is informed within a reasonable time.
15.2. Force majeure does not by itself remove the SELLER’s obligations under mandatory consumer law; the BUYER’s right to terminate and be refunded after the 30-day delivery period is kept.
Article 16. Complaints and Disputes
16.1. Requests about the order and the Contract can be sent to info@piercingland.com.tr, by phone to 0555 770 21 68 or to the KEP address. Email is preferred for written requests; that preference does not limit the BUYER’s rights to apply.
